Personal freedom versus the government's responsibility to keep society safe. States rights versus federal strength. These longtime standoffs have again donned a motorcycle helmet. The latest attempt to require motorcyclists to wear helmets went down 69 to 28 in the Senate last month. That was the fate of an amendment to the Federal Highway Bill by Sen.

The issue has been politically charged sincewhen highway funds were first linked to helmet use. Illinois adopted a universal helmet law inwhich was repealed in after the State Supreme Court declared it unconstitutional in In states without helmet laws, the Lautenberg proposal, like earlier rules, would divert a portion of the highway funds to federally mandated rider training courses.

Currently, 42 states now have some form of rider education. Lautenberg was trying to address recent Department of Transportation statistics that show 3, motorcyclists were killed in crashes in '04, "an almost two-fold increase from 10 years ago," he said. He linked increased deaths to unhelmeted riders, rather than to significant increases in the number of motorcyclists on the road.

The American Motorcyclist Association, which withmembers is the largest motorsports sanctioning body, also is alarmed at the fatalities.
